EdXcellence Event Speaker Terms & Conditions

These Terms & Conditions, together with any commercial terms (together referred to as "Agreement"), apply to you (Speaker, you, and your) when you are engaged to provide a presentation at an EdXcellence event. By registering as a Speaker and submitting Materials, you acknowledge that these Terms & Conditions have been read, understood, and accepted. For the purposes of these Terms & Conditions, "Materials" refers to any material submitted to EdXcellence, including abstracts, draft papers, final papers, PowerPoint presentations, and other materials. The Speaker acknowledges and agrees that these Terms & Conditions apply whether the EdXcellence event is delivered in-person, online, or in-person and online.

1. Agreement Formation

This Agreement applies to you if you: 1.1.1 Have registered as a Speaker for an EdXcellence event; and 1.1.2 Have submitted Material to EdXcellence for presentation

.

2. Exclusivity and Term

This Agreement commences on the date that EdXcellence receives your registration as a Speaker up until the completion of the event, unless stated otherwise.

3. Registration

3.1 Registration for an event will be made through the event's website or via EdXcellence. 3.2 EdXcellence does not charge any speaker fees for participation in its events. 3.3 Speakers will receive confirmation of registration and event information from EdXcellence via email or via the event Attendee Portal which is available on the event's website.

4. Editorial Process for Conference Papers

4.1 The EdXcellence Publications team will undertake an editorial process which is considered to commence upon receipt of your abstract.

5. Publication and Presentation

5.1 Speakers must submit their signed publication agreement. Without this, papers will not undergo the editing process and will not be published in either the printed proceedings or Online Repository. 5.2 Speakers must submit a PowerPoint presentation to the email address provided by EdXcellence. If the file size is too large for an email, please use a transfer site such as WeTransfer and notify EdXcellence.

6. On-Demand Presentations for Online or Hybrid Conferences

6.1 Upon the conclusion of the event, presentations for which permission were given may be made available on demand via the online platform for a period of time.

7. Personal Information

7.1 All personal information will be stored and processed in India in accordance with applicable Indian laws, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and any other relevant data protection regulations. 7.2 All personal information will be used by EdXcellence in accordance with its Privacy Policy, available on the EdXcellence website. 7.3 For Speakers located in the European Union and the United Kingdom, personal information will be used in accordance with the General Data Protection Regulations (GDPR) in addition to Indian laws, to the extent applicable. 7.4 EdXcellence's primary use for personal information will be for documenting attendance at the event and for future marketing. Event speakers will only be contacted for future marketing if they have granted EdXcellence with permission to do so at the time of registration.

7.5 Authorized Event/s Attendee List/s 7.5.1 Sponsors and attendees may receive an authorized copy of the event attendee list which will include details of Attendees who gave permission for this at the time of registration. 7.5.2 List/s may be used for future marketing purposes by event Sponsors.

8. Photography and Video

8.1 EdXcellence may take photography and/or video during the event and may use either for promotional purposes. This may include recording of online events. 8.2 If you do not wish to have your photo taken, please advise a member of EdXcellence.

9. Changes to Event

9.1 EdXcellence reserves the right to make changes to an event. This includes, but is not limited to, changes to the format, dates, timing, and content of the event schedule and/or presentation and Speakers.

10. Cancellation of Registration

10.1 The Speaker may request cancellation of their registration in writing to EdXcellence. As no fees are charged by EdXcellence, no refunds are applicable for cancellations.

11. Cancellation of Event by EdXcellence

11.1 EdXcellence reserves the right to cancel the event at any time and for any reason and accordingly be released from their obligation to the Speaker in accordance with these Terms & Conditions. 11.2 In the event of cancellation by EdXcellence, as no fees are collected from Speakers, no refunds are applicable. EdXcellence will not be liable for any costs incurred by the Speaker related to travel or accommodation.

12. Visa, Travel & Accmmodation

12.1 Speakers are responsible for their own travel arrangements and associated costs to Pune, India, for the in-person event. 12.2 EdXcellence will provide a visa invitation letter to Speakers upon request to facilitate their visa application process for travel to India. 12.3 EdXcellence will provide guidance and information regarding accommodation options in Pune, India, on the event's website to assist Speakers with their arrangements.

13. Limitation of Liability

13.1 The information contained in the presentations is for general educational and informative purposes only. Except to the extent required by Indian law, EdXcellence makes no representations or warranties express or implied as to the accuracy, reliability, or completeness of the information stored therein. 13.2 To the extent permitted by Indian law, EdXcellence will not be held liable for any loss or damage (including direct, indirect, special, or consequential) arising out of or in connection with an event. This includes: 13.2.1 The Speaker's reliance on anything contained in, or omitted from, the event (including, but not limited to, visual and audio presentations by other Speakers and sponsors). 13.2.2 The Speaker's inability to access an event and any associated services for any reason. 13.2.3 The failure of an event and any associated services for any reason. 13.3 The Speaker acknowledges that the information provided in the event is to assist the Speaker with undertaking their own enquiries and analyses and that the Speaker should seek independent professional advice before acting in reliance on the information contained therein. Whilst all care has been taken in presenting this information herein, no liability is accepted for errors or omissions. The views expressed in the presentations are those of the individual Speakers and may not necessarily reflect those of EdXcellence. 13.4 To the extent permitted by Indian law, EdXcellence will not be held liable for failure to perform under these Terms & Conditions to the extent such performance is affected by a force majeure event. A force majeure event is defined as any of the following, whether or not foreseeable or anticipated: Acts of God, terrorism, war, civil unrest, strike or labour dispute, breakdown, labour or material shortage, blockade or embargo, supplier failure, epidemic or pandemic (including COVID-19), government restriction or recommendation, legal requirement, extreme weather, earthquake, drought, fire, flood, explosion, natural disaster, and/or any other event, cause or circumstance that is beyond EdXcellence's reasonable control.

14. Miscellaneous

14.1 These Terms & Conditions are governed by the laws of India, specifically the laws applicable in Pune, Maharashtra. The Speaker submits to the exclusive jurisdiction of the courts in Pune, Maharashtra, to determine any matter or dispute which arises under these Terms & Conditions. 14.2 If any provision of these Terms & Conditions is deemed invalid or unenforceable, all or part of that provision will be severed from this document and will not affect the enforceability of the remaining provisions of the Terms & Conditions.

15. Changes to Terms & Conditions

​15.1 These Terms & Conditions are subject to change by EdXcellence at any time, without any prior or post notification.
